The following Terms of Service govern your access to and use of the uptimecheck.eu products and services, including the web application and any related websites, features, content, and services made available at or through the uptimecheck.eu platform (collectively, the “Services”). The Services are owned and operated by URI webTECHNOLOGIES (learn more at uriweb.hu) (the “Operator”).
The Services are offered on the condition that you accept these Terms of Service, together with any additional rules, policies, or guidelines that we may publish from time to time (including, without limitation, our Privacy Policy) (together, this “Agreement”).
Please read this Agreement carefully. By accessing or using any part of the Services, you agree to be bound by this Agreement. If you do not accept all terms of this Agreement, you may not access the Services or use any part of them. If these Terms are deemed an offer, acceptance is expressly limited to these Terms.
Updates to these Terms
We may revise these Terms and any supplemental terms that apply to the Services. Unless otherwise stated, changes take effect immediately upon publication and will be recorded in CHANGELOG. Where legally permitted, changes may apply to existing users and may affect ongoing use of the Services.
If you breach these Terms and we do not enforce them immediately, that does not mean we waive any rights (including the right to enforce the Terms later).
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Headings are used for convenience only and do not affect interpretation.
1. Your uptimecheck.eu Account and Use of the Services
If you create an account for the Services, you are responsible for maintaining the confidentiality and security of your access credentials (including, without limitation, your email address, password, and any API keys). You are responsible for all activity that occurs under your account and for any actions taken in connection with your account.
You may not use uptimecheck.eu in a deceptive, abusive, or unlawful way, including in a manner intended to exploit the name, brand, or reputation of others. We may modify, disable, or remove content (including monitors) that we reasonably believe is unlawful, inappropriate, violates this Agreement, or could expose uptimecheck.eu or the Operator to liability.
You must notify us without delay if you suspect any unauthorized access to your account or any security incident. uptimecheck.eu is not responsible for losses or damages resulting from your failure to secure your account, or from actions taken under your account.
2. Responsibility of Contributors
By using the Services, you agree that you are solely responsible for:
- providing accurate and current user information (such as your email address and name);
- not using the Services for illegal, harmful, or abusive purposes;
- safeguarding your account credentials (email, password, API keys);
- maintaining only one account (unless we explicitly approve multiple accounts for you).
We reserve the right (but do not assume an obligation) to, at our sole discretion:
- reject, remove, or disable any content or monitors that we believe violate any uptimecheck.eu policy or are harmful or objectionable; and/or
- suspend, restrict, or terminate access to the Services for any person or entity for any reason.
Except where required by law, we are not obligated to provide refunds for amounts previously paid.
3. Services Provided
uptimecheck.eu performs automated checks of the monitors you configure at intervals you select (or that are defined by your plan). If downtime or a relevant event is detected, the system may notify the contacts you configured using available notification channels (for example: email, SMS, mobile push notifications, and other methods depending on configuration and plan availability).
Monitoring methods may include:
- HTTP/HTTPS website monitoring
- Keyword monitoring (detecting the presence or absence of a defined keyword on a web page)
- Ping monitoring
- Port monitoring
- Heartbeat monitoring (cron-job monitoring; you send periodic requests and we verify timely arrival)
- Status pages (allowing you to publish uptime information for your audience)
Paid plans and additional features
We may offer optional paid plans that provide (for example) faster check intervals (often 1-minute checks), higher monitor limits (e.g., more than 10, 50, or more monitors), and/or included SMS or voice-call credits for notifications.
Depending on the plan tier, status pages may include a defined number of pages, unique uptimecheck.eu URLs, and/or an option to use a custom domain with TLS/SSL (for example, certificates issued by providers such as Let’s Encrypt or other, if supported). If a free plan exists, it may include a limited number of status pages with uptimecheck.eu-hosted URLs only.
Permitted Use of a Free Plan (if applicable)
If uptimecheck.eu provides a free plan, it is intended for personal, non-commercial use only—such as personal projects or personal websites. Using a free plan for commercial purposes (including business, institutional, or revenue-generating activity) is prohibited unless you have an appropriate paid subscription.
Commercial use without a suitable subscription may lead to suspension or termination of access to the Services.
Examples of prohibited free-plan use may include:
- monitoring uptime for business websites, applications, or services that generate revenue;
- monitoring systems for a for-profit organization, institution, or other commercial entity;
- embedding uptime metrics in client deliverables (reports, presentations, or similar business materials).
If your requirements go beyond personal use, you should choose a paid plan intended for business or institutional usage.
4. Refund Policy
4.1 General billing terms
Paid features may include add-ons such as additional monitors, additional seats, shorter check intervals, and/or SMS/voice call credit packages (each, an “Upgrade”). When you purchase an Upgrade, you agree to pay the fees shown for that Upgrade (monthly or annually, as applicable).
Payments are generally charged in advance on the purchase date and cover the selected billing period. For standalone credit packs, payment is typically a one-time prepayment, and auto-refill may be available if enabled by you.
If you request a plan change, we may apply proration for the current billing period. For upgrades, we may charge (or credit) the prorated difference. For downgrades, the change is typically scheduled to take effect at the next renewal date so your current plan remains active until the end of the prepaid period. In certain situations (e.g., very near expiration), the change may take effect sooner and without proration, depending on system rules.
If your account usage exceeds the limits of the new plan (e.g., number of monitors/seats), we may deny the downgrade or temporarily suspend resources that exceed the plan limits. Where practical, we will notify you in advance.
We reserve the right to modify fees and billing terms.
4.2 Automatic renewal
Unless you cancel before the end of the applicable subscription period, your subscription will automatically renew, and you authorize us to charge the then-current subscription fee (and any applicable taxes) using the payment method on file.
You can cancel upgrades/subscriptions within your account settings.
4.3 Refunds, withdrawal, and cancellation
Where applicable law grants a right of withdrawal, you may withdraw from the Agreement (including an Upgrade) within fourteen (14) calendar days of entering into it (the “Withdrawal Period”), without giving any reason. The right of withdrawal may not apply if you began using the paid Services with your explicit consent before the end of the Withdrawal Period, to the extent permitted by law.
If a valid withdrawal is made, we will reimburse payments received without undue delay and no later than fourteen (14) calendar days from the date we are informed of your withdrawal.
You may cancel an Upgrade at any time; you will not be charged for future renewal periods, but your existing prepaid period will continue until its end. Except within the Withdrawal Period (or where required by law), prepaid subscription fees are generally non-refundable. In exceptional cases (e.g., material breach by us), we may offer refunds or service credits at our discretion.

5. Delivery Policy
After we receive your order, we will provide the purchased Services according to the selected plan and these Terms. The time to activate or deliver Services may vary based on the product type and payment confirmation. Services are considered delivered once the relevant paid features are enabled and available in your account.
6. Intellectual Property
This Agreement does not transfer to you any intellectual property rights owned by uptimecheck.eu, URI webTECHNOLOGIES, or third parties. All rights, title, and interest remain with their respective owners.
The uptimecheck.eu name, logos, and related branding may be trademarks or service marks of the Operator. Other marks appearing in the Services may belong to third parties. Your use of the Services does not grant you any right to use or reproduce any trademark, logo, or branding except as expressly permitted in writing.
7. Advertisements
We may display advertisements or promotional content within the Services, including within user accounts, unless prohibited by law or by a paid plan that explicitly removes ads (if offered).
8. Changes
We may change, suspend, or discontinue parts of the Services at any time. We may also update these Terms. Where changes are material, we may provide notice via the website, in-app notifications, email (for active users), or other reasonable means. Changes will also be documented in changelog.
If you do not accept updated Terms, you must stop using the Services before the changes take effect. Continued use after the effective date constitutes acceptance.
9. Termination
We may suspend or terminate your access to all or part of the Services at any time, with or without cause, and with or without notice, where permitted by law.
You may terminate this Agreement by stopping use of the Services and, if applicable, canceling subscriptions.
Sections that by their nature should survive termination will survive, including (without limitation) intellectual property, disclaimers, limitations of liability, and indemnification.
10. Disclaimer of Warranties
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, uptimecheck.eu and its suppliers/licensors disclaim all warranties, whether express, implied, or statutory, including (without limitation) warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. You assume the risk of using the Services and of any content or data obtained through them.
11. Limitation of Liability
To the fullest extent permitted by law, neither uptimecheck.eu nor its suppliers/licensors will be liable under any theory of liability (contract, negligence, strict liability, or otherwise) for:
- indirect, incidental, special, consequential, or punitive damages;
- procurement of substitute products or services;
- interruption of use, loss of profits, loss of data, or data corruption; or
- any amount exceeding the fees you paid to uptimecheck.eu for the Services during the twelve (12) months prior to the event giving rise to the claim.
We will not be liable for failures or delays caused by circumstances beyond our reasonable control.
Some jurisdictions do not allow certain limitations; in such cases, these limits apply only to the extent permitted.
12. General Representations and Warranties
You represent and warrant that:
- you will use the Services in compliance with this Agreement, our policies (including the Privacy Policy), and all applicable laws and regulations (including rules relating to online conduct and acceptable content); and
- your use of the Services will not infringe or misappropriate the intellectual property rights of any third party.
13. Indemnification
You agree to defend, indemnify, and hold harmless uptimecheck.eu, URI webTECHNOLOGIES, and their directors, officers, employees, contractors, agents, suppliers, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, including your violation of this Agreement.
14. No Resale or Redistribution of Service
Unless expressly authorized in writing by uptimecheck.eu, you may not reproduce, duplicate, copy, sell, trade, resell, modify, create derivative works from, or commercially exploit any part of the Services, access to the Services, or the Services’ code.

It may be possible to purchase a plan for another account; billing details and invoices may be stored under the upgraded account.
If you violate this section, or if we reasonably suspect you have, we may suspend or terminate your subscription and deny current or future access. In such cases, you are generally not entitled to a refund except where required by law.
15. Affiliate Program
If uptimecheck.eu offers an affiliate program, participation is subject to these Terms and any affiliate-specific rules presented in the affiliate area.
Typical rules may include:
- commissions are calculated and paid on a scheduled basis (e.g., monthly);
- payouts may require reaching a minimum threshold and may be delayed until a minimum number of verified, paying referrals is reached;
- payouts may be limited to specific payment methods (e.g., PayPal), and lack of a valid payout method may prevent payout;
- chargebacks/refunds may void commissions;
- we may terminate affiliate accounts for violations or at our discretion;
- we do not guarantee error-free tracking and are not liable for tracking failures or indirect losses.

16. Referral Program
If uptimecheck.eu offers a referral program, you may earn non-cash rewards (such as merchandise or service benefits) for qualifying referrals, subject to the program rules.
Common conditions:
- rewards apply only to successful paid signups;
- reward levels may change over time and are based on the current rules displayed on the site;
- availability may vary by region and shipping constraints may apply;
- prohibited behavior may include coupon-site abuse, misleading offers, unauthorized coupons/links, self-referrals, spam, and certain forms of PPC using brand terms;
- we may disqualify referrals, void rewards, or terminate accounts for fraud or rule violations.

By contacting us, you grant uptimecheck.eu a worldwide, non-exclusive, perpetual right to use ideas, suggestions, and feedback you provide, without compensation, except where a written agreement states otherwise. Please do not send sensitive business information unless we have agreed in writing to receive it under confidentiality.
Email is not guaranteed to be secure or reliably delivered. For important matters, you should request confirmation of receipt. Unless explicitly stated otherwise in writing, email communications are generally considered informal and non-binding.
18. Data Processing Agreement (DPA)
uptimecheck.eu processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable local law. Where required, a separate Data Processing Agreement (“DPA”) may be made available to users who act as data controllers and process personal data through the Services. If provided, the DPA forms part of these Terms and can be requested via contact page.
The Services are not intended for individuals under sixteen (16) years of age, and we do not knowingly collect personal data from such individuals. If you believe a minor has provided personal data, contact us.
19. Miscellaneous / Governing Law and Jurisdiction
These Terms are governed by applicable Hungarian law and directly applicable European Union law. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the Sopron District Court (Soproni Járásbíróság), Hungary, unless mandatory consumer protection laws provide otherwise.
